Acceptance of terms
These Terms of Service govern your use of the Vid2Sprite website, studio workflow, and related materials provided by 2nd Foundry LLC. By accessing or using Vid2Sprite, you agree to these Terms.
If you do not agree to these Terms, do not use the service.
The service
Vid2Sprite is a browser-based creative tool intended to help users capture frames, clean backgrounds, arrange frame libraries, and export sprite-sheet assets. The service is offered for lawful creative, production, and evaluation workflows.
The current product does not require a user account or payment for core access, but we may change, improve, limit, or discontinue parts of the service over time.
Your responsibilities
You are responsible for how you use Vid2Sprite and for making sure you have all necessary rights, permissions, and legal authority for any video, artwork, audio, likenesses, or other material you process with the tool.
- Use the service only for lawful purposes.
- Review and validate exported assets in your own pipeline before relying on them for production, commercial, or publication use.
- Avoid using the service in a way that infringes intellectual property, privacy, publicity, contractual, or other rights.
- Maintain your own backups and workflow safeguards for source material and exported files.
Prohibited conduct
You agree not to misuse Vid2Sprite or interfere with its operation. For example, you may not:
- Use the service to violate law or the rights of others.
- Attempt to gain unauthorized access to the site, infrastructure, or related systems.
- Probe, scan, or test the vulnerability of the service in a harmful or unauthorized way.
- Upload, transmit, or introduce malicious code, automated abuse, or material intended to disrupt the product.
- Misrepresent your relationship to 2nd Foundry LLC or falsely imply endorsement.
Your content and rights
You retain whatever ownership rights you have in the source footage, images, and other materials you choose to process with Vid2Sprite, as well as in the exported outputs you lawfully create.
These Terms do not transfer ownership of your creative files to 2nd Foundry LLC. However, if you voluntarily send us feedback, examples, screenshots, or troubleshooting materials, you give us a non-exclusive, worldwide, royalty-free license to use those materials as reasonably necessary to respond to you, improve the service, and maintain internal business records.
Vid2Sprite intellectual property
The Vid2Sprite service, site design, software, branding, and related content are owned by 2nd Foundry LLC or its licensors and are protected by applicable intellectual property laws.
Except for the limited right to use the service under these Terms, no license or ownership interest in Vid2Sprite intellectual property is transferred to you.
Third-party services and links
Vid2Sprite may rely on or link to third-party services, tools, libraries, or websites. We are not responsible for third-party products or content, and your use of them may be governed by separate terms and privacy policies.
Availability, suspension, and termination
We may modify, suspend, or discontinue all or part of Vid2Sprite at any time, with or without notice. We may also restrict or terminate access if we believe use of the service creates legal, security, operational, or abuse-related risk.
Sections of these Terms that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnity, and governing law provisions.
Disclaimers
Vid2Sprite is provided on an as-is and as-available basis. To the fullest extent permitted by law, 2nd Foundry LLC disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that the service will always be available, uninterrupted, error-free, secure, or suitable for your specific workflow. You are responsible for evaluating whether the exported results are appropriate for your needs.
Limitation of liability and indemnity
To the fullest extent permitted by law, 2nd Foundry LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, data, or creative materials arising out of or related to your use of Vid2Sprite.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the service will not exceed the greater of the amount you paid us for the service in the twelve months before the claim or fifty U.S. dollars.
You agree to indemnify and hold harmless 2nd Foundry LLC from claims, damages, liabilities, and expenses arising from your content, your use of the service, or your violation of these Terms or applicable law.
Governing law, changes, and contact
These Terms are governed by applicable laws of the United States, without regard to conflict of law principles, except to the extent local law requires otherwise.
We may update these Terms from time to time by posting a revised version on this page. Your continued use of Vid2Sprite after updated Terms become effective constitutes acceptance of the revised Terms.
